Terms of Usage

1. Service Description

Nomscribe is an intellectual publishing platform that enables authors to write and publish articles through distinct personas — writing identities such as programmer, philosopher, or investor. The platform connects articles to structured knowledge entities including books, authors, quotes, topics, and events, building a living knowledge network where ideas, references, and discussions are interconnected.

Nomscribe is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

2. Content Ownership

You retain full ownership of all content you create and publish on Nomscribe, including articles, personas, annotations, and knowledge contributions. By publishing content, you grant Nomscribe a non-exclusive, royalty-free, worldwide license to display, distribute, and make your content available within the platform and its associated services.

This license terminates when you delete your content or close your account, subject to reasonable technical delays for propagation and backup systems.

3. User Obligations

As a user of Nomscribe, you agree to:

• Comply with all applicable laws and regulations in your jurisdiction.
• Not publish content that is defamatory, harassing, obscene, or infringes on third-party intellectual property rights.
• Not use the platform to distribute spam, malware, or unauthorized commercial promotions.
• Not attempt to gain unauthorized access to any part of the platform or its infrastructure.
• Maintain the accuracy of your account information and promptly update it when necessary.
• Not impersonate another person, entity, or Nomscribe staff.
• Respect the intellectual property and privacy rights of other users.

Violation of these obligations may result in content removal or account termination without prior notice.

4. Data & Privacy

Your privacy matters to us. By using Nomscribe, you acknowledge that we collect and process personal data as described in our Privacy Policy. This includes account information provided via OAuth providers (Google, GitHub, LinkedIn), usage analytics, and content you voluntarily publish.

We do not sell your personal data to third parties. Data is processed to operate, improve, and secure the platform. You may request deletion of your account and associated data at any time by contacting us.

5. Account Termination

You may close your account at any time from your profile settings. Upon closure, your published content will be removed from public view within a reasonable timeframe.

Nomscribe reserves the right to suspend or permanently terminate your account if you violate these Terms of Usage, engage in fraudulent activity, or cause harm to other users or the platform. We will attempt to notify you before termination except in cases of severe violations or legal requirements.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Nomscribe and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including loss of data, revenue, or goodwill.

Our total liability for any claim arising from or related to your use of the platform shall not exceed the amount you paid to Nomscribe in the twelve (12) months preceding the claim. If the service was provided free of charge, our maximum liability is BRL 100,00 (one hundred Brazilian Reais).

7. Governing Law

These Terms of Usage are governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law principles.

Any disputes arising from or relating to these terms or your use of Nomscribe shall be subject to the exclusive jurisdiction of the courts of the city of São Paulo, State of São Paulo, Brazil. You agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such disputes.

8. Changes to These Terms

Nomscribe reserves the right to update these Terms of Usage at any time. When material changes are made, we will notify you via the platform and require you to re-accept the updated terms before continuing to use the service. The effective date at the top of this page reflects when the current version was last updated.

Continued use of the platform after the notification period constitutes acceptance of the revised terms.
